The Fine Print

  • This raffle is conducted by a nonprofit public benefit corporation as a fundraising tool.  The raffle has been registered with the California Department of Justice and adheres to all applicable State and Federal gambling and raffle regulations.
  • All proceeds from this raffle directly benefit the Empress Theatre.  No outside vendors are paid to operate this raffle on behalf of the organization and no salaries are paid from the proceeds.
  • All prizes are awarded in as-is condition.  The Empress Theatre, Vallejo Community Arts Foundation, Inc., its employees, officers and volunteers neither warrant not guarantee the prizes in any way.
  • Tax, license, DMV and other fees are the responsibility of the winner.  Any delivery costs or transportation expenses are also the responsibility of the winner.
  • All prizes will be awarded, need not be present to win.
  • Raffle ticket sales are limited to 200 tickets. Assuming all 200 tickets sell, there will be a 1 in 200 chance of winning any particular prize and a 1 in 50 chance of winning a prize.  Chance of winning increases with multiple entry purchases or if all 200 tickets are not sold.
  • Ticket buyers and persons named on a ticket must be at least 18 years old upon purchase. Tickets can only be purchased in the name of individuals (not businesses). Employees, staff and Board members of Vallejo Community Arts Foundation, Inc. or the Empress Theatre can purchase tickets that name other individuals but cannot be named on a ticket.
  • A ticket can be purchased in the name of one or two individuals. If more than two names are on an entry form, then the first two names listed (as determined by the Foundation) will be deemed the holders of that ticket. Any prize and related tax liability belongs 100% to one person named on a ticket or 50% to each of two persons named. In the case that a ticket baring two names is drawn for a prize that is eligible only for one person (such as the Glider Adventure), the first name listed on the ticket will be deemed the winner and will maintain 100% ownership and tax liability for that prize.
  • Entry forms deemed by the theater to be defective, illegible or submitted without good funds may not be honored. The theater assumes no responsibility for lost, misdirected, late or non-delivered mail or other failure to timely purchase tickets, or for notifying anyone who attempts to purchase a ticket with a defective or illegible ticket or without good funds. All sales are final. No payments will be refunded, including payments received from ineligible parties, except at the theater's discretion.
  • Drawing dates may be extended at the theater’s discretion without notice. A list of the raffle winners will be postedon this website.
  • The theater will make reasonable efforts to contact winners using the information on the winning entry form.  If a winner cannot be located within 30 days after the drawing, or if any person is ineligible under these Rules or applicable law, then he/she will not be awarded the prize; no other ticket will be substituted for that ticket and the prize will be retained by the theater.  Any prize winner may elect to not accept a prize, in which case the prize will become the property of the Empress Theatre.

  • A prize winner may take an income tax deduction for donating a prize back to the theater only if the prize winner accepts the prize from the theater, reports the receipt of the prize on the prize winners’ federal and state income tax returns, and pays all income taxes applicable to the receipt of the prize.

  • Any prize not claimed within 60 days after that prize’s drawing will not be awarded. A person named on a ticket can not transfer his/her interest in the ticket.

  • Each winner is solely responsible for timely paying and reporting all taxes and expenses attributable to the prize, whether or not the Empress Theatre withholds taxes or complies with withholding laws.  Winners authorize the Empress Theatre to withhold all required amounts and shall indemnify, defend, protect and hold harmless the Empress Theatre and Vallejo Community Arts Foundation, Inc. from all related claims.

  • Each winner agrees his/her name, likeness, voice and city of residence may be recorded by audio, video, or digital means and may be used in any print, audio or visual media without notice or compensation for any purpose, including related to this or any other Foundation or Empress Theatre raffle.

  • Each winner, as a condition to being eligible to receive a prize, must sign and deliver to the theater: (a) a sworn affidavit of eligibility under these Rules and applicable law; (b) any information required by applicable law, including Social Security Number; (c) satisfactory proof the winner is 18 or older and is the person named on the winning entry; and (d) a publicity release.

  • Each person who purchases a ticket and/or whose name appears on a ticket: (a) agrees Vallejo Community Arts Foundation, Inc., the Empress Theatre, its directors, officers, employees, agents, representatives and the prize donors are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless Vallejo Community Arts Foundation, Inc., the Empress Theatre and the prize donors and their officers, directors, shareholders, employees, agents, advertising agency, contractors, insurers, attorneys, accountants and affiliated entities from and against all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of, or use of any prize; and (c) represents and warrants to the Foundation and the theater that he/she has read and understands these Rules and agrees to be bound by these Rules and the theater's decisions, which are final.

  • This raffle is void where prohibited by law.
